1. Acceptance of Terms

By downloading, installing, or using JourneyForge (the "Service"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, do not use the Service. These Terms apply to all users, including without limitation users who are browsers, players, and contributors of content.

2. Eligibility

You must be at least 13 years of age (or the age of digital consent in your jurisdiction, whichever is higher) to use the Service. By using the Service, you represent and warrant that you meet this age requirement. If you are under the applicable age of majority, you must have permission from a parent or legal guardian.

3. Account Registration

To access certain features, you must create an account. You agree to:

• Provide accurate, current, and complete registration information
• Maintain the security of your password and not share account credentials
• Notify us immediately of any unauthorized use of your account
• Accept responsibility for all activities that occur under your account

We reserve the right to terminate accounts, remove content, or cancel purchases at our sole discretion.

4. Virtual Items and In-App Purchases

The Service may offer virtual currency, items, characters, upgrades, and other digital content ("Virtual Items") for purchase or as in-game rewards. You acknowledge that:

• Virtual Items have no real-world monetary value and cannot be redeemed for cash or exchanged outside the Service
• All purchases of Virtual Items are final and non-refundable, except as required by applicable law or our refund policy
• We may modify, suspend, or discontinue Virtual Items at any time
• Virtual Items are licensed, not sold, and you acquire no ownership rights
• Purchases made through Apple App Store, Google Play, or Steam are subject to the respective platform's payment terms and refund policies

5. License to Use the Service

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the Service for your personal, non-commercial entertainment purposes. This license does not include the right to:

• Sublicense, sell, resell, or commercially exploit the Service
• Modify, adapt, reverse engineer, decompile, or disassemble any part of the Service
• Create derivative works based on the Service
• Access the Service using automated means (bots, scrapers, etc.)

6. User Conduct

You agree not to use the Service to:

• Cheat, exploit bugs, or use unauthorized third-party software to gain unfair advantages
• Harass, threaten, or harm other users
• Upload or transmit viruses, malicious code, or harmful content
• Impersonate any person or entity
• Violate any applicable local, national, or international law or regulation
• Attempt to gain unauthorized access to any portion of the Service or its infrastructure
• Engage in any activity that disrupts or interferes with the Service

Violations may result in immediate account suspension or permanent ban without refund.

7. Intellectual Property

All content in the Service, including but not limited to graphics, artwork, game mechanics, text, music, logos, and software, is owned by or licensed to JourneyForge and is protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, or create derivative works from any content without our express written permission.

8. User-Generated Content

To the extent the Service allows you to submit content (such as character names or profile information), you grant us a worldwide, royalty-free, perpetual license to use, display, and distribute that content in connection with the Service. You represent that you have the rights to grant this license and that your content does not infringe any third-party rights.

9. Disclaimers and Limitation of Liability

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

TO THE FULLEST EXTENT PERMITTED BY LAW, JOURNEYFORGE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) $100 USD.

10. Indemnification

You agree to indemnify, defend, and hold harmless JourneyForge and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in connection with your use of the Service, your violation of these Terms, or your violation of any rights of another party.

11. Termination

We may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. Upon termination, your right to use the Service will immediately cease. All provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, and limitations of liability.

12. Third-Party Platforms

The Service may be distributed through Apple App Store, Google Play, and Steam. Your use of the Service through these platforms is also subject to the applicable platform's terms of service. In the event of any conflict between these Terms and the platform's terms, the platform's terms will govern solely with respect to your relationship with that platform.

Apple Inc., Google LLC, and Valve Corporation are not parties to these Terms and bear no responsibility for the Service. Apple, Google, and Valve have no obligation to provide maintenance or support services for the Service.

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting an update in the app or by email. Your continued use of the Service after the effective date of the revised Terms constitutes your acceptance of the changes.

14. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles. Any disputes arising under these Terms shall first be attempted to be resolved through good-faith negotiation. If unresolved, disputes shall be submitted to binding arbitration in accordance with the American Arbitration Association rules, except that either party may seek injunctive or other equitable relief in a court of competent jurisdiction.

15. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall continue in full force and effect.
